AMATEUR ATHLETIC WAIVER AND RELEASE OF LIABILITY

AMATEUR ATHLETIC WAIVER AND RELEASE OF LIABILITY (“Release”)

In consideration of being allowed to participate in any way in Coyotes Curling Club related events and activities (collectively, the “Activities”), I:

1. Agree that the participant should inspect the facilities and equipment to be used in the Activities, and if the participant believes anything is unsafe, participant should immediately advise his/her coach/supervisor of such condition(s) and refuse to participate.
2. Acknowledge and fully understand that each participant will be engaging in Activities that involve risk of serious injury, including, without limitation, permanent disability and death, and severe social and economic losses which might result not only from their own actions, inactions, or negligence, but the action, inaction, or negligence of others, or the condition of the premises, or any equipment used in such Activities. Acknowledge that there may be other risks not known to us (Coyotes Curling Club) or not reasonably foreseeable at this time and accept and assume all such risks and all liability, losses, damages, costs, and expenses that may arise from participation in the Activities.
3. Assume all the foregoing risks and accept personal liability for all liability, losses, damages, costs, and expenses that may arise from participation in such Activities or such injury, permanent disability, or death.
4. Release, waive, discharge, and covenant NOT to sue Coyotes Curling Club, its affiliated clubs, their respective administrators, directors, agents, and other employees of the organization, other members/participants, coaches, volunteers, sponsoring agencies, sponsors, advertisers, and owners/lessors of premises used to conduct Activities from all liability, claims, demands, causes of action, damages, loss, or expense of any kind or nature (“Liability”) which may arise out of, result from, or relate to participation in the Activities, including claims for Liability on account of injury, including death and damage to property, caused or alleged to be caused in whole or in part by the negligence of the Release Parties or otherwise.
5. Agree that if participant or anyone on participant’s behalf makes a claim for Liability against any of the Released Parties, will indemnify, defend, and hold harmless each of the Released Parties from any such Liability that may be incurred because of such claim.
6. Certify, if the participant is a minor (less than 18 years of age), that I am the parent/guardian with legal responsibility for the participant, and consent and agree to all of the terms of this Release as provided above, on behalf of the minor in connection with the minor’s participation in the Activities. If anyone on the minor’s behalf makes a claim for Liability against any of the Released Parties, I will indemnify, defend, and hold harmless each of the Released Parties from all Liability which may be incurred as a result of such claim, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASED PARTIES, to the fullest extent permitted by law.
